Independent National Electoral Commission (INEC)
For the Personal Biometric Registration Application
The Independent National Electoral Commission ("INEC", "the Commission", "we", "our" or "us") is committed to protecting the privacy, confidentiality, integrity, and security of the personal information entrusted to it in the performance of its constitutional and statutory mandate.
This Privacy Policy explains how personal information is collected, used, stored, protected, disclosed, and otherwise processed through the INEC Personal Biometric Registration Application ("the App").
The App forms part of INEC's End-to-End Self-Service Registration for First-Time Voters and is designed to facilitate the secure electronic capture, processing, verification, and transmission of biometric data required for voter registration and identity verification.
The Commission recognises that biometric data constitutes sensitive personal data and is committed to processing such information responsibly, lawfully, fairly, and transparently in accordance with applicable laws, recognised privacy principles, and industry-accepted security standards.
This Privacy Policy is intended to assist applicants in understanding the nature of the personal information processed through the App, the purposes for which such information is processed, the safeguards implemented by the Commission, and the rights available to applicants under applicable data protection laws.
This Privacy Policy is issued in compliance with the Nigeria Data Protection Act, 2023 ("NDPA") and the regulatory framework administered by the Nigeria Data Protection Commission ("NDPC"). INEC is registered with the NDPC as a Data Controller of Major Importance and has appointed a Data Protection Officer to monitor compliance with applicable data protection requirements.
The Personal Biometric Registration Application ("the App") is not a standalone voter registration application.
The App has been developed to facilitate the secure capture, processing, verification, and submission of biometric data required as part of INEC's Self-Service Registration for First-Time Voters process.
Applicants commence their registration through the Continuous Voter Registration (CVR) Portal. At the appropriate stage of the registration process, applicants may be directed to download and use the App to complete the required biometric enrolment or verification process. Upon successful completion, the App securely transmits the biometric data to INEC's authorised backend systems. It redirects the applicant to the CVR Portal or such other authorised platform as may be applicable to complete the registration process.
The App does not independently process voter registration applications and should only be used in conjunction with INEC's official voter registration platforms and processes.
This Privacy Policy describes the Commission's practices relating to the collection and processing of personal information through the App.
It explains:
This Privacy Policy applies only to the Personal Biometric Registration Application and should be read together with the applicable electoral laws, regulations, policies and official notices governing the Continuous Voter Registration process.
Where any provision of this Privacy Policy conflicts with any applicable law, the applicable law shall prevail.

The Commission is committed to ensuring that personal information processed through the App is handled in accordance with the following principles:
The Commission implements data protection by design and by default in its voter registration systems and conducts Data Protection Impact Assessments for high-risk processing activities, including the processing of biometric and other sensitive personal data.
The Commission is committed to the principle of data minimisation and processes only the personal information that is necessary to facilitate biometric enrolment, identity verification, system security, and the administration of the voter registration process.
The App does not collect or process personal information beyond what is reasonably necessary for its intended lawful purposes.
Subject to the operation of the App and applicable legal requirements, the categories of information processed through the App include the following:

Such technical information is processed solely for operational, security, and administrative purposes and is not used to identify or profile applicants except where necessary to investigate technical issues, maintain system integrity, or comply with applicable legal obligations.
The Commission has designed the App in accordance with the principle of data minimisation and seeks to collect only the personal information necessary to support its lawful electoral functions.
Accordingly, except where expressly required for the operation of the App or otherwise authorised by law, the App does not collect, access, or process information such as:

The App is not intended to permanently retain personal information, including biometric data, on an applicant's mobile device after successful submission. Any temporary storage that occurs during the biometric registration process exists only for the period reasonably necessary to complete the registration session and facilitate the secure transmission of the information to the Commission's authorised information systems.
The Commission treats all personal information processed through the App as confidential and discloses such information only where necessary for the lawful administration of the voter registration process or as authorised or required by applicable law.
Personal information processed through the App may be disclosed to:
The Commission does not sell personal information or disclose it for advertising, marketing, or any other commercial purpose.
Personal information, including biometric data, captured through the App is primarily stored and processed within the Federal Republic of Nigeria on the Commission's authorised backend infrastructure.
Where personal data is transferred outside Nigeria, whether to a data processor or another recipient, the Commission ensures that such transfer complies with Part VIII of the NDPA by relying on an adequacy decision of the NDPC, appropriate safeguards, binding corporate rules, standard contractual clauses, or another lawful transfer mechanism recognised under the NDPA.
Contractual clauses for an appropriate level of data privacy protection are in place for any authorised data transfers involving service providers engaged to support the voter registration process.
The Commission has implemented appropriate technical, organisational, and administrative measures to protect personal information, including biometric data, processed through the App against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access.
Security measures include secure encrypted communication between the App and the Commission's authorised backend systems, secure registration session validation, authenticated backend services, controlled access to registration information, and other appropriate safeguards designed to maintain the confidentiality, integrity, and availability of personal information.
Personal information, including biometric data, is transmitted using secure communication protocols.
The Commission has put in place procedures to deal with any suspected personal data breach.

Where a personal data breach is likely to result in a high risk to your rights and freedoms, the Commission shall communicate the breach to you without undue delay in plain and clear language, including advice about measures you may take to mitigate possible adverse effects of the breach.
The Commission retains personal information, including biometric data, only for as long as is necessary to fulfil the purposes for which it was collected or as otherwise required or permitted by applicable law.
The App is not intended to permanently retain personal information, including biometric data, on an applicant's mobile device after successful submission. Any temporary retention on the device is limited to the period reasonably necessary to complete the biometric registration process and securely transmit the information to the Commission's authorised information systems.
Personal information processed through the App is retained in accordance with the Commission's records management policies, applicable electoral laws, the Nigeria Data Protection Act, 2023, and any other applicable legal or regulatory requirements. Where personal information is no longer required, the Commission will securely delete, archive, anonymise, or otherwise dispose of it in accordance with applicable law.
Subject to the provisions of the Nigeria Data Protection Act, 2023, and any other applicable laws governing the Commission's statutory functions, applicants whose personal information is processed through the App may, where applicable, exercise the following rights:
You have the right to be informed about the collection and processing of your personal information, including the purposes for which it is processed, the categories of information involved, and the safeguards implemented by the Commission.
You may request confirmation as to whether the Commission processes your personal information and, where applicable, request access to such information, subject to any lawful restrictions or exemptions.
Where your personal information is inaccurate, incomplete or outdated, you may request that it be corrected or updated in accordance with applicable procedures.
You may request that the Commission restrict the processing of your personal information where such restriction is permitted under applicable law.
You may object to certain categories of processing where such objection is recognised by applicable law. The Commission shall consider such requests in accordance with its statutory responsibilities and legal obligations.
Where permitted by law, you may request the deletion of your personal information. However, this right may be limited where the Commission is required to retain information for electoral, legal, archival or public interest purposes.
Where the processing of personal information is based solely on your consent, you may withdraw that consent at any time. Such withdrawal shall not affect the lawfulness of processing carried out before the withdrawal or any processing undertaken pursuant to the Commission's statutory authority.
Where personal data is processed through solely automated means, including profiling, that produces legal or similarly significant effects concerning you, you have the right to request human intervention, to express your point of view and to contest such decision, subject to applicable legal limitations connected with the Commission's electoral mandate.
Where processing is based on consent or on a contract and is carried out by automated means, you may request to receive your personal data in a structured, commonly used and machine-readable format, and to transmit that data to another controller where technically feasible, subject to applicable legal limitations.
If you believe that your personal information has been processed in a manner inconsistent with the Nigeria Data Protection Act, 2023, you may lodge a complaint with the Commission's Data Protection Officer or with the Nigeria Data Protection Commission (NDPC) in accordance with applicable legal requirements.
The exercise of these rights may be subject to constitutional, statutory and regulatory limitations applicable to the Commission in the discharge of its official functions. The Commission shall respond to valid data subject requests within the timeframes prescribed by the NDPA and NDPC guidance.
The App is intended solely for use by individuals who are legally eligible to register as voters under the Constitution of the Federal Republic of Nigeria, the Electoral Act and other applicable laws.
The Commission does not knowingly collect personal information from persons who are not legally eligible to register as voters through this App.
Where the Commission becomes aware that information has been submitted by an individual who is not legally eligible to use the App, appropriate action may be taken in accordance with applicable law and administrative procedures.
The Commission reserves the right to modify, amend, or update this Privacy Policy from time to time to reflect changes in applicable law, operational requirements, technology, security measures, administrative practices, or for any other lawful reason.
Any amendments shall be made by updating this Privacy Policy through the App. You are encouraged to review this Policy periodically to remain informed of any changes. Continued use of the App after any revised Policy has been published constitutes your acceptance of the revised Policy.
